1 RULES OF PROCEDURE FOR THE COMMISSION OF EXPERTS OF THE SUPERVISORY AUTHORITY OF THE INTERNATIONAL REGISTRY DEFINITIONS For the purpose of these Rules of Procedure, the following terms shall be considered to have the meanings indicated Convention the Convention on International Interests in Mobile Equipment, signed at Cape Town on 16 November 2001. Protocol the Protocol to the Convention on International Interests in Mobile Equipment on Matters specific to Aircraft Equipment, signed at Cape Town on 16 November 2001. Commission the Commission of Experts of the Supervisory Authority. Member or Commission Member a person appointed by the Supervisory Authority, on the basis of a nomination by a Signatory or Contracting State to the Convention and Protocol, to act on the Commission. Observer a non-Commission Member invited by the Commission, with the approval of the Supervisory Authority, to participate in meetings of the Commission. International Registry the international registration facilities established for the purposes of the Convention or the Protocol. Supervisory Authority or Supervisory Authority of the International Registry the Council of the International Civil Aviation Organization ICAO. Throughout these Rules of Procedure, the use of the male gender should be understood to include male and female persons.
2 Rule 1 Authority of the Supervisory Authority in regard to the Commission The Commission shall report directly and exclusively to the Supervisory Authority. Rule 2 Composition and Appointment a Pursuant to Article XVII 4 of the Protocol and Resolution No. 2 of the Cape Town Diplomatic Conference of 2001, the Commission shall be composed of not more than 15 Members having the necessary qualifications and experience in the field of the activities of the International Registry and the functions of the Supervisory Authority, as described in Articles 16 and 17 of the Convention and Article XX of the Protocol. b The term of Members shall last for a period of three years from the date of the initial appointment of Commission Members. c The Commission Members may be re-appointed for subsequent three-year terms. d If a Member is removed, or withdraws for any reason before the end of his term, the Supervisory Authority may appoint a successor from among persons nominated by the Signatory and Contracting States to the Convention and to the Protocol for the remainder of the term. Rule 3 Officers a The Commission shall elect from among its Members a Chairman and a Vice-Chairman. In the absence of the Chairman, the Vice-Chairman shall preside at meetings.
3 b The term of office of the Chairman and the Vice-Chairman shall last for three years. c The Chairman and the Vice-Chairman may be re-elected for one subsequent three-year term only. Their terms of office may in no case exceed their terms as Commission Members. d If the Chairman or the Vice-Chairman is unable to complete his term of office, a new Chairman or Vice-Chairman shall be elected by the Commission within 60 days and shall hold office only for the remainder of the term of his predecessor. e The Commission shall have a Secretary designated by the Secretary General of ICAO. Rule 4 Meetings and Consultations a The meetings of the Commission shall be convened at such times and places as may be approved by the Supervisory Authority. b Commission Members attending a meeting may be accompanied by no more than two advisers. c Observers may attend meetings of the Commission not held in private and may participate without vote in its deliberations. d In the case of necessity or urgency, and with the consent of the majority of the Members, a meeting of the Commission may be conducted by telephone or other telecommunications facilities as permit all participant Members in the meeting to hear each other. e The Commission may be consulted by the Supervisory Authority in writing, by e-mail or otherwise on matters that do not justify calling a meeting of the Commission.
