FOREWORD Historical background In October 1945, the Rules of the Air and Air Traffic Control RAC Division at its first session made recommendations for Standards, Practices and Procedures for the Rules of the Air. These were re- viewed by the then Air Navigation Com- mittee and approved by the Council on 25 February 1946. They were published as "Recommendations for Standards, Practices and Procedures - Rules of the Air" in the first part of Doc 2010- RAC/104, published in February 1946. The RAC Division, at its second ses- sion in December 1946 - January 1947, reviewed Doc 2010-RAC/104 and pro- posed Standards and Recommended Prac- tices for the Rules of the Air. These were adopted by the Council as Standards and Recommended Practices relating to Rules of the Air on 15 April 1948, pur- suant to Article 37 of the Convention on International Civil Aviation Chicago, 1944 and designated as Annex 2 to the Convention with the title "International Standards and Recommended Practices- Rules of the Air". They became effective on 15 September 1948. The third session of the RAC Division, in April-May 1948, recommended certain amendments to Annex 2. These amend- ments were submitted to States but it appeared that a re-arrangement of the material contained in the Annex was desirable to clarify certain points, particu- larly the application of the visual flight rules and the instrument flight rules. The fourth session of the RAC, Divi- sion made a complete review of the An- nex in November-December 1950. AS a result of its recommendations, a complete new text of the Annex, which no longer contained Recommended Practices, was adopted by the Council as Amendment 1 to Annex 2 on 27 November 1951, be- came effective on 1 April 1952 and became applicable on 1 September 1952. To reflect recommendations formulated by the Fourth Special Meeting of the RAC Committee of the European-Medi- terranean Region June- July 1952, for revision of procedures following a com- munications failure and for revising the information to be contained in the flight plan form, Amendment 2 to Annex 2 was adopted by the Council on 17 Nov- ember 1953, became effective on 1 April 1954 and became applicable on 1 Sep- tember 1954. Third Edition.-The third edition in- corporated provisions arising from the recommendations of the Second Air Nav- igation Conference Montreal, August- September 1955 which resulted in Amendment 3 being adopted by the Coun- cil on 11 May 1956. This became effec- tive on 15 September 1956 and applicable on 1 December 1956. Amendment 4 was approved by the Council on 14 November 1958. It incor- porated a new Attachment C containing explanatory notes on the application of the definitions of Danger Area, Prohi- bited Area and Restricted Area. Since the amendment related only to guidance material, no formal adoption was neces- sary and no considerations of dates of effectiveness and applicability were involved. Fourth Edition.-The present edition incorporates provisions arising from the recommendations of the Rules of the Air, Air Traffic Services and Search and Rescue Divisions Montreal, October- November 1958 and a change to Appendix A, paragraph 4 - Marshalling Signals Nos. 2 and 10- initiated by the Air Navigation Commission, which re- sulted in Amendment 5 being adopted by the Council on 8 December 1959. This became effective on 1 May 1960 and applicable on 1 August 1960. Amendment 6, which was adopted by the Council on 13 December 1961, be- came effective on 1 April 1962 and became applicable on 1 July 1962. It introduced changes to the table of quad- rantal cruising levels in Appendix C and the provisions associated therewith to pro- vide for the application of an increased vertical separatiop minimum in the upper airspace for flights outside controlled air- space no less than within controlled air- space. These changes derived from a recommendation made by the Rules of the Air, Air Traffic Services and Search and Rescue Divisions Montreal, October- November 1958. The amendment also incorporated changes to the provisions for navigation lights in Appendix B, to provide for the display of high-intensity lights commonly referred to as anti- collision lights. These changes derived from a recommendation made by the Fourth Meeting of the Airworthiness Committee Montreal, October-November 1960. Amendment 7, which was adopted by the Council on 27 June 1962, became effective on 1 November 1962 and be- came applicable on 1 December 1962. It introduced changes to the provisions governing the application of the table of cruising levels at Appendix C to cater for flights in polar areas where refer- ence to magnetic track is impractical. This amendment resulted from a recom- mendation made by the Fourth- North Atlantic Regional Air Navigation Meet- ing Paris, September-October 1961. Applicability The Standards in this document, to- gether with the Standards and Recom- mended Practices of Annex 11, govern the application of the "Procedures for Air Navigation Services-Rules of the Air and Air Trafic Services" and the "Regional Supplementary Procedures- Rules of the Air and Air Trafic Serv- ices", in which latter document will be found subsidiary procedures of regional application. Flight over the high seas.-It should be noted that the Council resolved, in adopting Annex 2 in April 1948 and Amendment 1 to the said Annex in Nov- ember 1951, that the Annex constitutes Rules relating to the flight and manmu- vre of aircraft within the meaning of Article 12 of the Convention. Over the high seas, therefore, these rules apply without exception. On 16 September. 1952 the Council, considering a request for an interpreta- tion of 3.1.2 of Annex 2, declared as follows "In applying paragraph 3.1.2 of the International Standards for Rules of the Air Annex 2 to the Convention on International Civil Aviation, the 'appropriate authority' in the case of flight over the high seas should be in- terpreted as the appropriate authority of the State of Registry and, in all other 1/12/62 No. 7
