MULTILATERAL AGREEMENT on Commercial Rights of Non-Scheduled Air Services in Europe Coxsroxc. Illat it is the policy of each of the States parties to the Agree- iiicnt that aircraft engaged in non- .clcduled commercial flights within Europe which do not harm their scheduled services may be freely admitted to their territories for the purpose of taking on or discharging traffic, CONSIDERING that the treatment pro- vided by the provisions of the first paragraph of Article 5 of the Conven- tion on International Civil Aviation drawn up at Chicago on 7 December 1944 hereinafter called "the Conven- tion" - which applies to the inter- national movements of private and commercial aircraft engaged in non- scheduled operations on flights into or in transit non-stop across the territo- ries of the States parties to that Con- vention and to stops therein for non- traffic purposes - is satisfactory, and DESIRING to arrive at further agree- ment as to the right of their respective commercial aircraft to take on and discharge passengers, cargo or mail on international flights for remuneration or hire on other than international scheduled services, as provided in the second paragraph of Article 5 of the Convention, HAVE CONCLUDED this Agreement to that end. CONSIDERANDO que cada uno de 10s Estados partes del Acuerdo tiene como objetivo admitir libremente en su territorio, para el embarque o desem- barque de tdfico, a las aeronaves que efectlian vuelos comerciales no regu- lares intraeuropeos que no causen perjuicio a sus servicios regulares, CONSIDERANDO que es satisfactorio el regimen estipulado en las disposi- ciones del primer parrafo del Articulo 5 del Convenio de Aviaci6n Civil International, firmado en Chicago el 7 de diciembre de 1944 que en adelan- te se denominara "el Convenio", que afecta a 10s movimientos internaciooa- les de aeronaves privadas y comercia- les, dedicadas a vuelos no regulares que llegan a 10s territorios de 10s Estados partes en dicho Convenio, o que pasan sobre ellos sin hacer escala o que llacen escala con fines no comer- ciales, y DESEANW Ilegar a un acuerdo mis amplio, que regule el derecho de sus respectivas aeronaves comerciales a embarcar y desembarcar pasajeros, carga o correo, en vuelos internacio- nales, efectuados por remuneracibn o alquiler, distintos de 10s servicios re- gulares internacionales, de conformi- dad con el segundd p6rrafo del Articulo 5 de dicho Convenio, HAN CONCLU el presente Acuerdo con dicho fin.
